By participating in rides with Cycle Tours NSW, you declare that:

1. Any bicycle you use that is not supplied by Cycle Tours NSW is in good working order, tyres with a safe amount of tread and inflated to the manufacturer’s recommended operating pressure, working brakes, lights and a bell;
2. You will be prepared with water bottles and equipment to fix or replace a flat tyre;
3. You understand the ride will follow roads shared with other road users and will obey all road rules;
4. You understand the expected distance and gradients involved in the ride, and;
5. You have experience of such rides and have the physical fitness and ability to complete the ride safely;
6. You understand that unless provided as a funded option, there is no “sad wagon” (car rescue) service. Unless otherwise organised, you start and finish ride under your own steam;
7. You understand and participate in any ride with Cycle Tours NSW at your own risk. Cycle Tours NSW will not provide any insurance, personal, third party, property, accident or other, and accept no liability should an accident occur;
8. You understand that it is a pre-requisite to arrange your own personal and third-party cyclist insurance;
9. You agree to indemnify and hold harmless Cycle Tours NSW and its directors, officers, employees, agents, stockholders, affiliates, subcontractors and customers from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation legal fees and costs) which arise out of, relate to or result from any act or omission of Cycle Tours NSW.

DELIVERY OF GOODS

Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of Cycle Tours NSW.

Digital goods are delivered immediately. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

RETURNS AND REFUNDS

Cycle Tours NSW handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

Should you wish to return your order, please notify us within days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly, and payment made by the same method that you made payment. All refunds are made at the discretion of Cycle Tours NSW.

JURISDICTION

This agreement and this website are subject to the laws of NSW and Australia. If there is a dispute between you and Cycle Tours NSW that results in litigation, then you must submit to the jurisdiction of the courts of NSW.
